The judge overseeing the case against Real Madrid defender Raúl Asencio has issued a clarification, removing one of the most serious accusations initially leveled against him. The updated ruling, issued on Thursday, confirms that Asencio is no longer being charged with the crime of recording sexually explicit videos, a charge that had previously been included in the indictment.

According to the judicial order, accessed by EFE, the judge acknowledges that “there is no evidence he participated in the recording of the images,” and therefore, Asencio cannot even be provisionally charged with involvement in the alleged unlawful recording. This correction comes just 24 hours after the judge had officially ended the investigative phase and listed charges against Asencio and his three former teammates from Real Madrid’s youth academy — Juan Rodríguez, Ferrán Ruiz, and Andrés García.

All four had initially faced the same three charges:

• Recording sexually explicit videos without consent,

• Sharing intimate images, and

• Child pornography, as one of the victims was underage.

However, the judge now states that Asencio was not involved in the sexual encounter during which the videos were recorded. He was reportedly in the communal pool with another girl, separate from the private cabin where the incident occurred. As a result, the charge related to the actual recording of the encounter has been dropped in his case.

Nonetheless, two charges remain against Asencio:

1. Disclosing secrets, for allegedly showing the video to a third party,

2. Child pornography, because the video involved a minor, and Asencio was aware of her age.

The case centers on events that occurred on June 15, 2023, at a beach club in Amadores, in southern Gran Canaria. The four footballers, aged 20 and 21 at the time, spent the day socializing with three young women, one of whom had informed them that she was 16 years old.

During the afternoon, Ferrán Ruiz, along with Rodríguez and García, allegedly engaged in consensual sex with two of the girls inside a private cabin. Ruiz reportedly began recording the act without the girls’ knowledge and passed the phone to Rodríguez, who continued filming. The girls only became aware of the recording partway through, but by then, some of the footage had already been captured.

Although the recordings were supposedly deleted at the scene, the videos were later shared via messaging apps, including group chats, and were saved by some recipients.

Psychological assessments referenced in the indictment report that both victims have since been diagnosed with post-traumatic stress disorder (PTSD). The underage victim, in particular, suffers from symptoms that severely impact her academic and social life.
