The new Santiago Bernabéu is proving to be a significant asset for Real Madrid, not only for hosting concerts and major events but also due to its impressive and innovative hypogeum engineering, which maintains the pitch and allows for large-scale events. According to the latest information from El Mundo, Real Madrid holds the patent for the retractable grass system, meaning anyone wishing to replicate it will have to pay a fee.

Reportedly, Real Madrid included an exclusivity clause in their contract with the Sener Group, the engineering company behind the hypogeum. This clause prohibits the Sener Group, managed by the Sendagorta family, from marketing this solution in any European country for 30 years. Specifically, during the first 15 years, the ban is absolute, covering both sports stadiums and other leisure spaces within Europe. After this initial period, the restriction will remain, though the Sener Group can accept orders with Real Madrid's approval until the 30-year agreement concludes.

El Mundo also notes that the Sener Group has pursued legal action to challenge the exclusivity clause in the 2020 contract with Real Madrid. However, it appears unlikely that the company will succeed, as it's difficult to argue that a multinational with 60 years of experience was unaware of the contract terms at the time of signing. Therefore, if anyone else wants to install a hypogeum like the one at Santiago Bernabéu, they will need to seek permission from Real Madrid and pay the necessary fees.
